1. Scope and contract formation
These Terms apply to the Nihility website, MultiLoader, product access, updates, support, and related services. Product pages and the checkout summary form part of the offer. A contract is formed only after payment is verified server-side and we issue an order confirmation or access entitlement. A payment-provider redirect or pending transaction is not acceptance or fulfillment.
2. Account and security
You must provide accurate information, keep your account and device session secure, and promptly report suspected compromise. Accounts and licenses are personal unless a written business plan expressly says otherwise. Sharing, selling, leasing, or publishing an account, key, session, or entitlement is prohibited.
3. Software license
For the paid term, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to run the identified software on supported systems for lawful purposes. Ownership and intellectual-property rights remain with Nihility and its licensors. No source-code, trademark, resale, sublicensing, or redistribution rights are granted.
4. Restrictions and acceptable use
You must follow the Acceptable Use Policy and all applicable laws and third-party platform or server rules. In particular, you may not:
- circumvent licensing, device binding, access controls, signatures, update verification, or security limits;
- reverse engineer, decompile, modify, scrape, exploit, or probe the service except where mandatory law expressly permits it;
- use the service to harm systems or people, distribute malware, infringe rights, evade sanctions, commit fraud, or facilitate unauthorized access;
- misrepresent affiliation, abuse support, manipulate reviews, or interfere with other users or service availability.
5. Subscription term, delivery, and updates
The selected duration starts when the entitlement is first issued, unless the checkout summary states otherwise. A lifetime plan means the supported lifetime of the identified product or service, not the lifetime of a person or any guaranteed minimum period. Supported functionality, compatibility, and system requirements are described on the product page. Security, compatibility, and feature updates may be delivered automatically. Material changes follow applicable law and will not remove mandatory consumer remedies.
6. Prices and crypto payments
The checkout displays the total fiat-denominated price and the payment provider supplies the crypto quote, asset, network, amount, and expiry. You are responsible for selecting the exact displayed network and paying network fees. Underpayments, overpayments, expired quotes, duplicate transfers, wrong-network transfers, refunds, and provider failures are reviewed under the Refund and Withdrawal Policy and the payment provider's rules. We never ask for a seed phrase or wallet private key.
7. Suspension and termination
We may restrict or revoke access for a material breach, fraud, payment reversal abuse, credential sharing, security risk, legal requirement, or conduct that threatens the service or third parties. Where reasonably possible, we will give notice and an opportunity to remedy. Immediate action may be necessary for serious or urgent risks. Statutory refund, conformity, and damages rights remain unaffected.
8. Availability and third-party services
We use reasonable care but do not promise uninterrupted availability or perpetual compatibility with third-party software, games, servers, operating systems, networks, wallets, or payment providers. Third parties may change or discontinue their services independently. Nothing in these Terms authorizes conduct prohibited by a third party.
9. Statutory conformity and warranties
Consumers retain mandatory statutory rights for digital products, including conformity and required updates. Any additional guarantee applies only if expressly stated in writing. To the maximum extent permitted for non-consumer transactions, the service is otherwise supplied without additional implied warranties.
10. Liability
Nothing excludes or limits liability for intent, gross negligence, death or personal injury, fraud, product liability, or another liability that cannot lawfully be limited. For slight negligence, liability is limited to breaches of essential contractual duties and to damage typical and foreseeable when the contract was made. Mandatory consumer rights remain unaffected.
11. Governing law and changes
German law applies, excluding conflict rules and the CISG, without depriving a consumer of mandatory protection in their country of residence. Mandatory consumer jurisdiction rules apply. We may update these Terms for legal, security, or operational reasons; material adverse changes will be notified in advance where required.
